If a product offered by EarthLinks itself is not as described, your sole remedy is to return it in unused condition within 10 days of purchase.

If the order has been confirmed and charged to your credit card, EarthLinks shall issue a credit in the amount of the incorrect price.

EARTHLINKS STANDARD TERMS AND CONDITIONS OF SALE
All sales are subject to the following terms and conditions:
1.    Customer Acknowledgment.
Customer acknowledges agreement with these Terms of Sale by the placement of an order to purchase a Product from EarthLinks. 
2.    All Sales Made In Colorado.
All sales shall be deemed made in the State of Colorado, USA, regardless of the location of the Customer. 
3.    Purchase Price.
(a) Prices are listed in EarthLinks’ catalogs and website, and are subject to change without notice. Prices for certain wholesale customers will be set forth in a separate written agreement between the parties. (b) Payment is due before shipment unless credit terms have been arranged in advance with EarthLinks. In such case, payment terms shall be as set forth in the agreement. (c) EarthLinks will not ship to locations outside of the U.S.
4.    Shipping Terms.
Shipping terms are: F.O.B. Denver, CO. EarthLinks will arrange payment for shipping with the carrier, but such costs are the responsibility of Customer. EarthLinks does not ship outside of the U.S. Risk of loss is upon Customer once EarthLinks delivers the Product to the carrier. Delivery times are estimates only and EarthLinks shall not be liable for delays. 
5.    Returns
All sales are final. However, within thirty (30) days of purchase  , we will replace or repair, at our sole discretion, any shipped product that is deemed defective.  
6.    DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, EARTHLINKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EARTHLINKS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE PRODUCTS PURCHASED THROUGH THIS SITE, THE CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. These Terms of Sale represent the complete and final agreement between the Customer and EarthLinks for the matters set forth herein, and shall be supplemented only by the prices, quantity, and descriptions set forth in EarthLinks’ invoice for the relevant sale. Terms contained in Customers' purchase orders, offers to buy, terms and conditions, and the like shall have no effect. 

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

DISPUTES

The Colorado Uniform Arbitration Act and Colorado Law govern this agreement. Any small claims court actions, arbitrations or other legal actions shall take place in Denver, Colorado.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

APPLICABLE LAW
By visiting Earthlinks-colorado.org, you agree that the Colorado Uniform Arbitration Act, and the laws of the State of Colorado, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and EarthLinks.
